This website is found at www.thehobbyshop.co.za and is owned by Model Railroad Specialists (CK ) We trade as The Hobby Shop. “we”, “us” , “our” ,”Model Railroad Specialists” and “The Hobby Shop” – these terms are used interchangeably. The website is developed by D-Base solutions and hosted by Altonsa.

These Website Terms of Business (“Terms of Business”) govern the ordering, sale, delivery and return of goods as well the use of this Website as a resource for information.

To buy anything on our website, or use any of the website resources – you will have to agree to the Terms of Business as outlined below.

These Terms of Business are binding and enforceable against every person that accesses or uses this Website (“you”, “your” or “user”), including without limitation each user who registers (“registered user”). By using the Website and by clicking on the “Register Now” button on the Website, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms of Business.

  1. We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks; and possibly changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of this website for any financial gain. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

  • You (the ‘buyer”, customer” or “registered user” undertake to provide accurate registration details including Name, ID number, Cell number, and address (In South Africa). Failure will result in immediate suspension from buying on this website. You are responsible for updating your details, should you have anything to update or change.
  • We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
  • We reserve the right to change any prices without notice. This may be due to exchange rates or pricing errors. We reserve the right to limit quantities or cancel any order at our sole discretion. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. You may cancel your order, should you wish (as a result of unplanned price change). We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
  • We endeavour to make every effort to supply accurate information for each product but this may on occasion be inaccurate and we absolve ourselves from such unintentional misinformation. Colors presented on the website might differ slightly from what you see on your monitor or what they are when delivered. We may on occasion use information from 3rd party vendors and we will not be held liable for their content.
  •  We undertake to match any price provided that the price we are matching is from a legitimate brick & mortar store (ie not on-line only store) and that the store must have the item in stock and available to purchase at the time of the enquiry. The store must be located within the borders of South Africa.
  • You agree to indemnify, Model Railroad Specialists and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

RETURNS POLICY

We have a 30-day return policy, which means you have 30 calender days after purchasing your item to request a return. You must contact us immediately should your parcel arrive damaged or not at all so that we can chase up with delivery vendor. You can contact us on sales@thehobbyshop.co.za Products that are returned have to be UN-USED and in original packaging. You need to request a return to us and provide a receipt (proof of purchase) to sales@thehobbyshop.co.za

PRE-OWNED ON-LINE STORE

The Website also hosts a ‘pre-owned’, ‘used’ or ‘second hand’ store. ALL these items are sold ‘as is’ ie with no manufacturer guarantee. We do try to give accurate information regarding the condition of these items. You are welcome to request more information and images of these items to our WhatsApp number or email sales@thehobbyshop.co.za Due to the nature of these items there is usually only the 1 item in stock and due to timings between updates of our ‘brick & Morter’ store and the website – the item may no longer be available at time of purchase. This is why no payment can be made for these items until availability is confirmed. We will endeavour to make this confirmation with 24 business hours via email or WhatsApp. You may also request us to confirm availability via email or WhatsApp before purchasing. Our condition descriptions are as follows

  1. Mint As New – Item is as the day it was bought – never used and in original packaging.
    1. Mint Boxed – Item is in mint condition in original packaging. Item may have been used.
    1. Mint Unboxed – Item is in mint condition but no original packaging
    1. Excellent – Item is in excellent/great condition with slight signs of use. Will be stipulated if it has original box or not (ie Excellent Boxed or Excellent Unboxed)
    1. Fair Condition – Item shows signs of use but is in working order
    1. Poor Condition – Not in good condition, can be used as spares. Parts may be missing 😊

SHIPPING POLICY

  1. Shipping services are restricted to the Republic of South Africa; we therefore do not offer any international or cross border shipping services via the website. If you require any such service, please kindly arrange with your own preferred courier services or contact us for a quotation.
  2. Most orders are shipped via The Courier Guy/ Pargo within 3 to 4 business days of your order being placed. Please allow 2 to 3 days for delivery to main centres and 3 to 5 days for outlying areas. We make every attempt to deliver your product as fast as possible, but we cannot guarantee delivery times. To ensure that you receive your order when you need it, please plan accordingly. During the holidays, please place your order at least one week prior to ensure timely delivery.
  3. In the event of your parcel requiring a dedicated special trip to deliver the shipment, additional charges may be levied. There may also be towns with a special surcharge. Examples of special delivery area include mines, power stations, plots, farms, military bases, game lodges, port / harbours, embassies, and consulates. If there are any additional levies you will be contacted before delivery.
  4. Delivery times are usually between 8:00AM and 5:00PM on weekdays (Monday to Friday) excluding public holidays.
  5. Required Signature. All parcels require a signature on delivery, however, in the event that no one is available to sign for your delivery required a note will be left noting the attempted delivery. After two attempts to deliver, the package will be returned to The Hobby Shop
  6. Confirmation. Once your order has been shipped, you will receive an email informing you of your package being shipped. If you desire a tracking number, please email sales@thehobbyshop.co.za and we will gladly forward it to you.
  7. Insurance. PLEASE NOTE: that The Hobby Shop cannot be held for any loss or damage of products while being shipped. We therefore encourage you to make use of the Optional Insurance offered by The Courier Guy/ Pargo available on the Check Out page.

BACK ORDERS

  1. Back orders can be ‘ordered’ for some items that are not currently physically in our store. These are usually products that are ordered by us – that are on there way to us.
  2. If you order something on back order you then commit to take it when it becomes available in your cart.
  3. There is usually a date stipulated when we expect the item to be arriving. These dates are not cast in stone and are only indicative of arrival of the product into our store.
  4. If you cancel items that you ordered on back order we then reserve the right to bar you from using the back order system in the future. This is because the stock is reserved for you and therefor cannot be sold to someone else too.

The Hobby shop reserves the right to change this policy at any time. Please check back from time to time to note any changes.
